Jonathan M. Hernandez

Biography

Jonathan concentrates his practice on intellectual property litigation and counseling, with a focus on complex patent and trademark disputes.  His practice covers a wide range of technologies and industries, including medical devices, telecommunications, electronics, software, biotechnology, animal genetics, and video games.

Jonathan has represented clients in federal district courts throughout the country and before the Patent Trial and Appeal Board. His professional experience as an engineer for two multinational companies gives him a unique perspective to approaching complex, high-stakes IP matters, allowing him to better understand and meet the business and legal needs of his clients.

During law school, Jonathan served as the assistant information editor for the South Texas Law Review and was inducted into the National Order of Scribes for his legal writing accomplishments. He also served as a judicial intern for the Honorable Frances H. Stacy in the U.S. District Court for the Southern District of Texas.

Before law school, Jonathan was an applications engineer for an energy technology company, where he was responsible for industrial gas turbine projects. As an engineer for an oilfield equipment supplier, he then managed technical specifications and commercial proposals for land rig projects.

Outside the Firm

Jonathan enjoys golfing, exploring new music, and spending time with his family, including coaching his son’s baseball team. As a native Houstonian, he is an avid fan of Houston’s sports teams and arts.

Experience

  • Counsel for defendants in patent infringement action involving image rendering technology in video games. Prevailed on summary judgement of non-infringement on all asserted claims.
  • Counsel for defendant in patent infringement action involving ultrasound diagnostic hardware and software, as well as related inter partes review proceeding. Favorable settlement achieved for client following successful IPR institutions.
  • Counsel for plaintiffs in patent infringement action involving microfluidic cell sorting technology; also defended clients against patent infringement and antitrust counterclaims.  Favorable settlement secured for client.
  • Counsel for defendant in patent infringement action involving SMS technology. Case dismissed with prejudice based on finding of invalidity under 35 U.S.C. § 101.
  • Counsel for plaintiff in multiple patent infringement actions asserting 12+ patents related to voice over packet technology.
  • Counsel for an insurance technology company defending against trademark infringement and unfair competition claims. Favorable settlement secured for client.

Professional Activities

Jonathan serves as a regional director of the Giles S. Rich Memorial Moot Court Competition for the American Intellectual Property Law Association and the moot court committee chair for the Houston Intellectual Property Law Association. He also serves on the Diversity, Equity & Inclusion Committee for the Houston Bar Association and is a member of the Hispanic National Bar Association and Mexican American Bar Association of Houston.

Jonathan previously served on the HBA’s Communities in Schools Committee and as a mentor in the organization’s summer legal internship program. He is also involved with The Children’s Assessment Center.
